Hi,
I am transferring my H1B from Employer A to B.
With Employer A, I had my recent H1B extension approved till Oct 31 2011.
I am going to have the period on this transfer as June 1 2009 - Oct 31 2011. (Which will 6 yrs in total on H1B status for me).
I have question on form I-129, "Requested Action" section.
Out of the following options, which one should I "Check":
1. Extend the stay of the person(s) since they now hold this status.
2. Amend the stay of the person(s) since they now hold this status.
Please let me know.

Hi Gurus,
If you look at my signature, My 485 has been transferred to TSC from NSC and AP is still stuck at NSC. I have some emergent situation back home , I have faxed the doctor certificate and called USCIS using POJ method and the guy says it might take another month. wat the *****....tried infopass..my local office doesnt have no more appointments.
My questions:
1. Can I take Infopass appointment anywhere else which is not my local office?
2. Can I apply a new 131 application at TSC as my 485 is there now?
Someone pls advise.

I have a question regarding location change with same employer. I have labor approved on EB2 India with PD 01/2005. I am employed with a big health care firm which has various locations in the region. I'd like to move to another location which is 30 miles away from my present site. I140 is pending with the same employer. I have also posed this question to my lawyer but appreciate greatly if anyone knows answer to this. Will this affect my GC?

I am in a situation where I changed my Job and new organization has filed the Visa Transfer process on 28 May 2010.
My and my dependents current H1-B / H4 and I-94 from the prior organization is expiring on March 14 2011 and the H1-B Transfer process has not been completed and rather it is now in the RFE Status as of Today i.e March - 7 2011.
Am I still eligible to stay in US or not. What should be my next course of action.
Please suggest at the earliest.

I have a approved I-140 with company A. It is a substitute labor.
I am getting laid off end of the month and I have a new offer from company B.
Can I port priority date of this I-140 to new company B? Does porting work for substitute labor also?

Can someone clarify my issue.
I applied for H1-b in 2008(I was in L1 when i applied).My employer never gave me my recipt number and i didnt even knw the status for a while ( though he said he applied without COS).Later he told it was applied with COS.
Later after numberous calls and mail he gave me a recipt number ,but the
status on USCIS website was "Notice Undelivered as of June 2008".
I could never find ,whether it was RFE or Approved status.I called up USCIS they said employer has to call to confirm the status.My employer said he will follow up with USCIS but he never did and he is absconding now .I cant reach him ,no phone,no mails.So i continued on L1.
Since my extension is coming up.I wanted to make sure my status hasnt changed because of this issue.
Has anyone faced this situation? Had that notice (undelivered) been an approval letter ,would that change my status though it was never accepted (Its undelivered as of Jun 2008)

Hello everyone ! 13 years ago i was charge with Lanercy-theft wich it was a 2nd deg misdemeanor and possesion of cannabis under 20 grams 1st deg misdemeanor i plead guilty and served 3 days in county jail (Florida) , now i'm 32 married to an American citizen and getting ready to adjust my status , i just want to know how hard it"s going to be this whole process , i dont want to be dinied or deported , thanks for any answers.

if the dependent is planning to come back on AP and then start working on EAD, does it mean the primary applicant has to work on EAD or the primary applicant can still continue on H1.

This year, seven months after the opening of the filing season that started on April 1st, the H-1B cap has yet to be reached. However, the numbers may not last long. I filed AP for me and my Dependent , Unfortunately USCIS just picked the application on the top of packet ( My Application ) and i got the receipt No , I dont know what happened to my Spouces Application her check is not cashed and no receipt no , I suppose her applicaiton is was just placed with my applicaiton and was considered as just one application .
Now what are my options , can i go ahead and file one more application , i know its literally impossible for me to call uscis and Track my wife's application , can i go and file a new application for my Spouse . Please advice.
